ROSS DUCKS $61M DAMAGE AWARD

cdc software logoRoss Systems, a subsidiary of CDC Software, has agreed to pay $9 million to settle litigation brought by Sunshine Mills, one of the company’s customers in a prolonged and nasty court fight involving the parties. Late in 2010, one blogger called the legal confrontation "a sorry mess".
That’s a lot better than the $61 million in real and punitive damages awarded late last year by a jury hearing the case in the Circuit Court of Franklin County, Ala. Ross also agreed that by September 7 it would deposit $500,000 into an escrow account that would be maintained until Sunshine produces evidence that it is no longer using Ross Software. Sunshine will also get a settlement of $487,000 from the Illinois Union Insurance Co. once there is a stipulation or motion to settle a suit against the insurance company. Sunshine also gets to keep $412,769 that was the result of garnishments by the company. The parties agreed to bear their own legal costs. The legal actions stemmed from Sunshine’s claim for damages based on alleged fraud related to the sale and implementation of a Ross ERP system in early 2005 when Ross was hired to replace an AS/400 system. Sunshine claimed it had to manually write off thousands of invoices when the system failed. Ross alleged that Sunshine had caused its own problems and continued to use the software for years before filing suit and also purchased more products from Ross during the litigation.
