EPICOR WINS INJUNCTION ON ATS

atsEpicor Software has obtained a nationwide injunction against Alternative Technology Solutions, which it had accused of copyright and trademark infringement, among other issues. Irvine, Calif.-based Epicor will seek substantial damages, according to its general counsel John Ireland. ATS was also accused of unlawful and fraudulent business practices, intentional interference with Epicor Software License agreements, and unjust enrichment.

Aliso Viejo, Calif.-based ATS, the suit said, illegally use or duplicated Epicor software to provide unauthorized consulting and software customization services to Epicor customers and also alleged Epicor falsely represented itself as an Epicor partner. The injunction bars ATS from possessing, copying or using any Epicor products or documentation that are not validly licensed. ATS cannot also use licensed software for an impermissible purpose. After the suit was filed in March, VTS issued a statement denying the claims. ATS said its services actually help Epicor expand its market.
