EPICOR WINS ATS SUIT Featured

Vivian Keena, Alternative Technology SolutionsEpicor Software has won a sweeping victory in a suit that alleged copyright and property infringement by Alternative Technology Solutions, a consulting firm based in Altos Viejo, Calif. ATS must turn over to Epicor all business and assets it used in servicing Epicor customers, as well as the Alternative brand name, domain names, website and phone numbers. Ouch! ATS and its principal shareholders also must make what were termed substantial payments to Epicor.

The amounts were not disclosed. The defendants include CEO Vivian Keena and CTO Donna Barnett. Epicor filed its action in March 2013 alleging the company misappropriated and misused Epicor's intellectual property and proprietary and confidential information. Many of the ATS executives had worked at Epicor and the company sold extensions and add-ons that target Epicor 9 users and also perform integration between Epicor 9 and Salesforce.com and Magento. At the time, one observer said ATS made its living fixing "screwed up Epicor installations." ATS and the individual defendants are permanently enjoined from further violations and the company and its principal shareholders entered what was termed 'a stringent non-compete agreement, which restricts them from providing competitive products or services to Epicor's customers. '
